Terms and Conditions

Kleenex® “WIN A SUZUKI SWIFT” PROMOTION

  1. Information on how to enter this Promotion and Prizes form part of these terms and conditions. Entry into the Promotion is deemed to be acceptance of these terms and conditions. Any entry not complying with these terms and conditions is invalid.
  2. Entry is only open to residents of New Zealand. Employees of the Promoter, their immediate families and employees of the agencies associated with this Promotion, and for text entries Vodafone and Telecom, are ineligible to enter.
  3. The Promotion commences 12:01am on 01/04/08 and closes at 11:59pm on 30/09/08 (“Promotion Period”).
  4. To enter the Promotion, entrants must purchase one stickered promotional pack of Kleenex® facial tissues from participating retailers and text, email or mail the unique entry code found on the reverse of the promotional sticker (“Entry Code”) with other relevant details in accordance with the entry instructions.
  5. Each Entry Code can only be used once either by text entry, by web entry or by mail. Each text message costs $0.20 including GST and is the responsibility of the entrant. Text entries can only be made from NZ mobile phones. A text entry is deemed to be from the individual who is the registered user of the mobile phone from which the entry was sent. If the winning entry was entered by text, the Prize will be awarded to the registered user of the mobile phone from which the text was sent.
  6. You can enter a monthly Prize draw as many times as you like provided that each entry is made with a valid Entry Code obtained from the purchase of a stickered promotional pack of Kleenex® facial tissues. Entries in a particular month will only participate in the Prize draw on the draw date for of the month of entry during the Promotion Period. Close-off for entries is at 11.59pm NZST on 31/05/08, 30/06/08, 31/07/08, 31/08/08 and 30/09/08.
  7. Prize draws will take place on each of the following dates: 01/05/08, 03/06/08, 01/07/08, 01/08/08, 01/09/08 and 01/10/08.
  8. The first valid entry drawn for each monthly draw will win a new 2008 Suzuki SWIFT motor vehicle (the “Prize”). The Prize is either a Limited Edition automatic Suzuki Swift model, 1.5VVT with dual air bags, ABS brakes and central locking, or a Suzuki Swift Sport model, manual 1.6 DOHC with dual air bags, ABS brakes, ESP (Electronic Stability Programme) and central locking. The Prize also includes all on-road costs (excluding insurance), 3 years’ roadside assistance, comprehensive 3 year/100,000 km warranty and a full tank of fuel. The Prize will be delivered to the Suzuki dealer situated nearest to the given address of a Prize winner (“Winner”). If a Winner is under the age of 18, the Prize may be awarded to the Winner’s parent or guardian at the Promoter’s discretion. The Winner may nominate his/her preferred model.
  9. The value of the Prizes is NZ$21,990 for the Limited Edition Suzuki Swift and NZ$24,990 for the Suzuki Swift Sport. The Promoter accepts no responsibility for variations in Prize value.
  10. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission or for any misdirected or late entry. The Promoter is not responsible for any problems or technical malfunction of any telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
  11. If for any reason this Promotion is not capable of running as planned (whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter) which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion.
  12. Winners will be notified by phone/mail. The Promoter accepts no responsibility for the inability to contact Winners due to illegibility or error in information provided by them, or subsequent change of address or phone number.
  13. Entrants are advised to keep the Kleenex® facial tissue barcode and promotional sticker featuring the Entry Code as proof of purchase and Winners may be required to present this barcode and sticker to claim their Prize. Winners (and anyone receiving the benefit of a Prize) may be required to sign a release in a form determined by the Promoter.
  14. The Promoter reserves the right to verify the validity of entries and claims and to require proof of identity (e.g. driver’s licence and/or passport), and in the case of text entries, evidence that the Winner is the registered user of the relevant mobile phone. The Promoter reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with the entry process. The Promoter’s decision is final and no correspondence will be entered into.
  15. Prizes are not transferable or exchangeable and cannot be taken as cash.
  16. All entries become the property of the Promoter. The personal information requested must be provided for a valid Prize claim. Entering by text authorises Vodafone and Telecom to release your mobile phone number to the Promoter or its agencies. The information will be used solely for verifying entries and contacting the Winners of each Prize draw. Under the Privacy Act 1993, entrants have the right to access and correct any such personal information. Failure to provide all the requested information at the time of submitting an entry may result in an entry being invalid. All information collected will be destroyed after all Prizes have been claimed.
  17. Entry into this Promotion is deemed as consent to use Winners’ names and photographs for any broadcast or publicity associated with this Promotion, including on the Promoter’s website. Winners agree to be available for reasonable publicity purposes without compensation.
  18. The Promoter, its agents and contractors shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, direct, indirect or consequential loss) or for personal injury or death howsoever suffered or sustained, arising from or in connection with any Prizes offered, received or used as part of this Promotion, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum amount allowable by law).

  20. Any tax liability arising as a result of accepting any Prize is the responsibility of the Winner.
  21. These Terms and conditions are governed by the laws of New Zealand.
