Kleenex ‘Win your share of $200,000 every hour’ Promotion
- Information on how to enter and prizes form part of these Conditions of Entry. Entry into the “Kleenex 2007 Cash” Promotion (“Promotion”) is deemed to be an acceptance of these terms and conditions. Entry is via SMS, phone or the internet.
- Entry is only open to Australian residents over the age of 18 years. Employees (and their immediate families) of Kimberly-Clark Australia Pty Ltd and its printers, suppliers, providers, outlets and agencies associated with this promotion are ineligible to enter.
- The Promotion commences on 07/05/07 at 9:00am AEST and concludes on 31/08/07 at 23:59pm AEST (the “Promotional Period”).

To enter the Promotion, entrants must:
- purchase any one (1) specially marked Kleenex brand facial tissue product containing a promotional sticker (“Promotional Product”). Entrants must then look under the promotional sticker to reveal a 10 digit unique code (“Promotional Code”);

during the Promotional Period either:
- Call 1900 998 765 and follow the prompts; or
- Send a SMS to 1999 8765 from a mobile telephone, (without caller id blocking), with the Promotional Code, entrant’s name and state of residence; or
- Log on to www.kleenex.com/au and follow the prompts;
and
- retain the original Promotional Code and Promotional Product barcode as proof of purchase.
- SMS entries must not withhold the display of the mobile telephone number from which the entry is placed. Entries made where the mobile telephone number is withheld will be deemed to be invalid. SMS entries via the internet are not valid and will not be accepted. The SMS mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider, which permits messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. Any costs associated with accessing the promotional website are the entrant’s responsibility and are dependent on the internet service provider used.
- Entrants who enter via phone or the internet will be asked to correctly enter their contact details including (but not limited to) full name, address including postcode and daytime contact number. Any contact details entered incorrectly will result in the entry being deemed invalid. Incomplete, inaudible or incomprehensible entries will be deemed invalid.
- The maximum call cost of a 1900 call is AUD0.55 including GST. Mobile phones and pay phones may attract a higher rate. SMS entries are charged at AUD0.55 including GST. 1900 services are provided by Informatel of 1/187 Johnston St, Fitzroy VIC 3065.
- Entries are deemed to be received at the time of receipt into the Promoter’s database irrespective of when they are sent or submitted. All required information must be received by the Promoter during the Promotional Period for the entry to be valid. No responsibility will be taken for lost, late or misdirected entries, Promotional Codes or barcodes.
- Each Promotional Code is valid for one entry only. Unrecognised codes will not be accepted. You can enter more than once, but a Promotional Code may only be used for one entry.
- Entrants must retain proof of purchase in the form of the original Promotional Code and the barcode from the Promotional Product. Instant winners will be required to send their winning Promotional Code and the barcode from the Promotional Product to the Promoter for verification purposes and in order to claim their prize. The Promoter must receive winning Promotional Codes and barcodes by last mail on 28/09/2007. The Promoter will notify winners of a reply paid address for this purpose. The Promoter recommends that proof of purchase of the Promotional Product be sent via registered post, however this is not a condition of entry and the cost to do so will be the responsibility of the winner. Entrants can only enter the Promotion in their own name. The Promoter reserves the right to request winners to provide proof of identity and age at the nominated prize delivery address (to the Promoter’s satisfaction, in its sole discretion) before issuing a prize.
- The Promoter reserves the right to verify the validity of all entries and Promotional Codes and barcodes from Promotional Products. The Promoter may disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these conditions of entry (including but not limited to where the Promotional Code andbarcode are not from the same Promotional Product.) Any entry made with stolen, forged, mutilated, unrecognised or tampered with Promotional Codes or barcodes will be deemed void.
- One entry received during each hour of the Promotional Period will receive an instant win prize. Winners will be notified if they are an instant winner. If there are no entries received during any one-hour period during the Promotional Period, the first valid entry received the following hour will be awarded the previous hour’s instant win prize.
- One instant prize will be awarded randomly every hour during the Promotional Period. The instant win prize pool consists of: 1x $20,000; 1 x $10,000; 2 x $5,000; 10 x $1,000; 21x $500; 26 x $100; and 2738 x $50.00 cash prizes. Cash prizes will be awarded in the form of a non-negotiable cheque made payable to the winner.
- The total prize pool value is $200,000. Prizes are not transferable or exchangeable. The Promoter retains the right to substitute the prize with a prize of equal or greater value subject to approval of the gaming authorities in each State and Territory where relevant.
- Printing and other quality control errors will not invalidate an otherwise valid instant win prize claim. Up to 15,000,000 Promotional Product stickers (Promotional Codes) will be printed for this Promotion.
- Any tax liability as a result of accepting any prize is the responsibility of the winner.
- Winners will be notified by mail. Winners of instant prizes over the value of $100 will be published in the public notices section of the Australian on 25/05/07, 29/06/07, 27/07/07, 24/08/07 or 28/09/07.
- The Promoter may contact an entrant at any time after receiving an entry, including without limitation during or after the Promotional Period or after the second chanceprize draw, for the purpose of determining whether the entrant meets the eligibility requirements of the Promotion.
- All valid entries received during the Promotional Period that did not win an instant win prize during the Promotional Period will be placed in a second chance prize draw for any unclaimed prizes. The second chance prize draw will take place at 12pm EDST on 23/11/07 at Informatel, 1/187 Johnston St, Fitzroy VIC 3065, subject however to any written directions given by any applicable gaming authorities and under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). Winners drawn will be notified by mail and their details will be published in the public notices section of The Australian on 21/12/07.
- The Promoter’s decision in relation to any aspects of the Promotion are final and binding on every person who enters the Promotion and no correspondence will be entered into.
- The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with the Promotion or receiving, taking or using any prize except for any liability which cannot be excluded by law, (in which case that liability is limited to the minimum allowable by law).
- The Promoter and its agents will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation, technical malfunctions or failures.
- The Promoter and its agents are not responsible for any incorrect or inaccurate information, either caused by the phone user or website user for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communication line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to entrants or any other person’s computer related to or resulting from participation in or downloading any material in this Promotion.
- The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions of entry, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- All entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If the information requested is not provided, the entrant may not participate in the Promotion. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners names published as required under the relevant lottery legislation. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available upon request). A request to access, update or correct any information should be directed to the Promoter at its address set out below.
- If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to modify the terms of the Promotion including these Conditions of Entry and prizes, and/or to cancel the Promotion and recommence it from the start on the same conditions subject to approval of the gaming authorities in each State and Territory where relevant.
- These Conditions of Entry are governed by the law of New South Wales.
